RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, AND INDEMNITY AGREEMENT
By entering the premises located at 310 E High St, Pottstown, PA 19464, I, the undersigned, acknowledge, appreciate, and agree to the following terms:
Release and Waiver of Claims: I hereby release, waive, discharge, and covenant not to sue COSMIC ARTS LLC, its owners, officers, employees, agents, tenants, and any other business entities operating within the premises of 310 E High St, Pottstown, PA 19464, from any and all liabilities, claims, demands, actions, and causes of actions whatsoever arising out of or related to any loss, damage, injury, illness, or death, that may be sustained by me, or to any property belonging to me, while on or upon the premises where COSMIC ARTS LLC is conducted, or any premises under the control and supervision of COSMIC ARTS LLC, its owners, officers, employees, or agents.
Assumption of Risk: I am aware that my presence and participation in activities within the premises involve risks, including, but not limited to, the risk of personal injury, illness, death, or damage to my property. These risks may result from the actions, negligence, or failure to act of myself and others (including but not limited to the premises owner, tenants, and other patrons). I understand that there are also risks of injury or illness from the herbal drinks served on the premises, including intoxication and impairment of my abilities, and the possibility of causing a false positive on drug screenings. I knowingly and freely assume all such risks, both known and unknown, and assume full responsibility for my participation and actions within the premises.
Drink Notice: I acknowledge that herbal drinks, as well as BYOB drinks served at the premises may impair my ability to operate motor vehicles or engage in other potentially dangerous activities. I assume all responsibility for any decision to drive or operate machinery after consuming such beverages.
Age Restriction and BYOB Policy: I acknowledge that any person under the age of 18 must be accompanied by an adult. I also understand that BYOB is permitted for patrons over the age of 21 who are dining in and have had their ID checked, in accordance with the premises' policy. No illegal substances are allowed in the building.
Release of Liability for Departure: I hereby release, waive, discharge, and covenant not to sue COSMIC ARTS LLC, its owners, officers, employees, agents, tenants, and any other business entities operating within or associated with the premises, from any and all liabilities, claims, demands, actions, and causes of actions whatsoever arising out of or related to any loss, damage, injury, illness, or death, that may be sustained by myself or others, or to any property belonging to myself or others, as a result of my decision to leave the premises, regardless of my condition at the time of departure.
No Driving Under the Influence: I agree, under no circumstances, to operate a motor vehicle, bicycle, or any other form of transportation if I am under the influence of alcohol, herbal drinks served on the premises, or any other substances that may impair my abilities. I understand the risks associated with driving while intoxicated, including the potential for serious injury or death to myself and others, and I assume all responsibility and liability for any decisions to drive or operate any vehicle or machinery under such conditions.
Acknowledgment of Legal Obligations and Responsibilities: I acknowledge that driving under the influence of intoxicants is illegal and subject to legal penalties, including but not limited to, fines, imprisonment, and the suspension or revocation of my driver's license. I accept all legal responsibilities and consequences for my actions related to the consumption of alcohol, herbal drinks, or any other substances, and my decision to drive or operate machinery after leaving the premises.
Commitment to Safety: I commit to taking all necessary precautions to ensure my own safety and the safety of others upon leaving the premises. This includes arranging for alternative transportation such as a designated driver, taxi, or ride-sharing service if I am not in a condition to safely operate a vehicle or machinery.
Property Damage: I agree to be solely responsible and liable for any damage I cause to the property of COSMIC ARTS LLC, its tenants, or other patrons during my time on the premises.
Photography and Videography Consent: I consent to have photographs and video taken of me during my visit to the premises, and I grant COSMIC ARTS LLC the right to use such photographs and videos for publicity, advertising, or other purposes on a royalty-free basis.
Compliance with Rules: I agree to abide by all rules and regulations set forth by COSMIC ARTS LLC and the premises, including but not limited to, no smoking policies and the prohibition of illegal substances.
Acknowledgment of Understanding: I have read this release of liability and assumption of risk agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
